Randy Travis sentenced to 180 days in jail for DUI, but receives probation

Country singer Randy Travis has been sentenced after his August 2012 drunk driving incident. He plead guilty to the incident, and was sentenced to 180 days in jail on Thursday.

However, he most likely won't spend any time behind bars. In this case, it's not because of jail overcrowding, which is how folks like Lindsay Lohan, Paris Hilton, and others always seem to spend a few hours in jail, and then are released. Instead, Travis' sentence was probated for two years.

In other words, he's on probation for two years. As long as he stays on the straight and narrow for that time, he'll avoid jail. If however, he has a legal problem, authorities can bring him in and make him serve the 180 days.

In addition to probation, Travis must check in to an inpatient alcohol treatment facility for a minimum of 30 days and complete 100 hours of community service.

Finrally, Travis must also install an ignition interlock device on any vehicle he drives for the next two years. The interlock measures a driver's blood alcohol level and will prevent the engine from starting if the driver's BAC is above the legal limit.

Travis was arrested for DUI on Aug. 7, 2012. Police found him lying naked in the roadway, having crashed his car in a construction area in Texas.

Day one of Dr. Phil's Ronaiah Tuiasosopo interview: Hoaxster preps to do Kekua voice

Monti Te'o's hoaxster, Ronaiah Tuisosopo, appeared in the first part of his interview with Dr. Phil on Thursday. The second part will be aired on Friday.

In the Thursday segment, Tuisosopo said what was previewed on "Today" on Wednesday: that he believes he is gay. During the Wednesday preview, Dr. Phil also noted that Tuisosopo told him that he "performed" the voice of Teo's fictitious girlfriend Lennay Kekua, and that he fell in love with Te'o during the faux relationship.

On Thursday, during the actual interview as opposed to the preview, Tuiasosopo's explanations and descriptions fell in line with events we already knew about. He said he felt real feelings toward Te'o and that once, when he called him and a girl picked up, he got angry. You might recall a voicemail excerpt was revealed earlier, regarding that incident.

On the night that Manti Te'o's grandmother died, Te'o supposedly told Lennay that he never wanted to speak to her again. Tuiasosopo said that was why Lennay "died" that same night.

Dr. Phil asked Ronaiah Tuiasosopo flat out: "Are you gay?" To that, Tuiasosopo replied, "If you look at this situation and everything that I've been through, I would say yeah I'm gay. But honestly I'm so confused."

He added that he feels he needs to recover from his homosexuality. Tuiasosopo is a deeply religious Christian, which could explain his reference to recovery, which sounds along the lines of ex-gay therapy.

Tuisosopo said, "It takes a lot of courage to recover from homosexuality and this type of thing and coming back to your real life. As hard of a task it is, I'm going to do all I can to live right."

Dr. Phil was taken aback by that statement. He replied, "This is for another time, but I have so much to say to you about what you just said, because a lot of it bothers me so much. But we will talk about that another time."

The episode concluded with a cliffhanger. Tuiasosopo's lawyer had told the New York Daily News that his client performed the voice, but the New York Post reported that a female cousin, Tino, handled the voice.

When pressed to do the voice, Tuiasosopo told Dr. Phil that he couldn't do the voice as he was too embarrassed. However, Dr. Phil gave Tuiasosopo a privacy screen, and as Tuiasosopo prepared to perform, it was ... cliffhanger time.

Beyonce opens press conference with National Anthem, admits lip syncing for Obama

Lip sync-gate is over. On Thursday, Beyonce came clean and admitted that she lip synced "The Star Spangled Banner" during the second public inauguration ceremonies for U.S. President Barack Obama.

While at the news conference for her upcoming Super Bowl XLVII halftime show, Beyonce launched into the impromptu performance of the anthem and, as can be seen from the embedded video, killed the song. Once she finished she simply said, “Any questions?”

During the conference, she was indeed asked about lip syncing at the Presidential Inauguration last week, and she admitted she used a backing track. She said,
I am a perfectionist. I did not have time to rehearse with the orchestra [at the Inauguration]. It was a live television show and a very important moment for me.

Due to the weather, due to the delay, due to no proper sound check, I did not feel comfortable taking the risk ... so I decided to sing along with my pre-recorded track, which is very common in the music industry. And I’m very proud of my performance.
When asked about her Super Bowl performance, Beyonce seemed rather sheepish and vague. She replied "I always sing live," implying it would be live, but remember -- always didn't apply to the inauguration. However, weather won't be a problem in the dome on Feb. 3.

She was also asked about a possible Destiny's Child appearance. She hedged on the answer, which is strange since Michelle Williams said there was to be no appearance at Super Bowl XLVII.

The topic of did she or didn't she turned into a huge bruhaha since after Obama's inauguration. It went so far that Sen. Chuck Schumer (D-N.Y.) asked for an apology from the pop superstar.

This press conference, as well as her impromptu performance, should put things to rest.



Adult film legend Ron Jeremy to remain hospitalized for at least two weeks: Report

Adult film star Ron Jeremy will remain hospitalized for at least two weeks, after his Wednesday dual surgeries to fix an aneurysm near his heart. The update on his current condition was issued Thursday.

Jeremy, a legend in the porn industry, drove himself to Cedars-Sinai hospital Tuesday afternoon with severe chest pain. Doctors who examined the legendary porn star discovered an aneurysm near his heart.

After his condition continued to decline, doctors performed two surgeries on Jeremy on Wednesday. After his second surgery, Jeremey's manager Mike Esterman said that he was informed by the surgeons that everything went "smoothly," adding that "Ron is now resting with complete privacy and no visitors."

On Thursday, though, a source said that "Ron is in [the] ICU and will be there for a few days, but will remain at the hospital for at least two weeks until doctors can see how he reacts to the surgeries.”  The report added that Jeremy is still in critical condition.

Jeremy's 94-year-old father Arnold Hyatt said, "Right now everything is in a holding pattern. He's heavily sedated and intubated. The doctors are waiting to see what develops. They anticipate it will be two or three days before they take him off the respirator."

An aneurysm is a localized, blood-filled balloon-like bulge in the wall of a blood vessel. If it were to rupture, an aneurysm could result in severe hemorrhage and even death.

Ron Jeremy is 59; he will turn 60 on March 12. He was born Ronald Jeremy Hyatt and earned the nickname "The Hedgehog" after a somewhat bizarre incident on the set of "Olympic Fever," shot in 1979.

Jeremy was ranked by AVN at number one in their "The 50 Top Porn Stars of All Time" list. his entry on the Internet Adult Film Database lists over 2,000 films in which he has performed, and an additional 281 films which he directed.

He has also appeared in non-pornographic films, such as "Crank: High Voltage," "Girls Gone Dead," "The Chase," "Orgazmo," "They Bite," "The Boondock Saints," and "54."

Coke's Super Bowl XLVII ad joins VW's as a target of racism allegations

Super Bowl ads are usually well-thought out -- they have to be; they are so pricey (Groupon's 2011 FUBAR notwithstanding). However, on Wednesday, the American-Arab Anti-Discrimination Committee, or ADC, complained about Coca-Cola's upcoming Super Bowl XLVII ad.

Coca-Cola's online teaser of the ad was posted last week (embedded). While not the full ad, and part of a voting promotion, it shows an Arab walking through a desert leading a camel and a caravan. He runs into cowboys, Las Vegas showgirls in a bus, and a group reminiscent of the marauders in the apocalyptic "Mad Max" film. They all race by him in an attempt to reach a huge bottle of Coke, sitting in the middle of the desert.

In the ad, Coke asks viewers to vote on which of the characters should win the race (at http:/www.cokechase.com). The Arab character, to be clear, is not trying to win the race and cannot be voted upon.

Imam Ali Siddiqui, president of the Muslim Institute for Interfaith Studies, said in an email,
The Coke commercial for the Super Ball is racist, portraying Arabs as backward and foolish Camel Jockeys, and they have no chance to win in the world.
bed Ayoub, ADC's director of legal and policy affairs added:
What message is Coke sending with this? By not including the Arab in the race, it is clear that the Arab is held to a different standard when compared to the other characters in the commercial.
Ayoub said that the ADC intended to contact Coke and CBS on Thursday to "hopefully start a dialog."
I want to know why this happened and how can we fix this if possible before Sunday.
It is hard to imagine that Coke could change the ad prior to Sunday.

CBS is broadcasting Super Bowl XLVII, which pits the San Francisco 49ers against the Baltimore Ravens, but declined comment. Meanwhile, Coca-Cola spokeswoman Lauren Thompson said Coke took a "cinematic" approach to the ad.

The Coke ad is the second Super Bowl XLVII ad to be accused of racism. Volkswagen's ad has been criticized for possibly using Jamaican stereotypes.

Dan Marino admits to NFL love child: Affair, previously unknown daughter

This seems to be a trend with CBS. NFL legend Dan Marino, who is a pregame analyst for CBS NFL coverage, admitted on Thursday that he had an affair with a a CBS Sports production assistant in 2004, and got her pregnant, as well.

Marino admitted to the affair with CBS Sports employee production assistant Donna Savattere. Savattere was 35 at the time, and Marino was 42. The two had a daughter, Chloe, in June 2005. That was apparently a good year for Marino -- depending on how you look at things -- he was inducted into the NFL Hall of Fame in 2005.

For those wondering, Marino was -- and still is -- married to his wife, Claire, in 2004. Dan and Claire Marino have been married for 28 years.

The couple has six children, Daniel Charles (born September 1986), Michael Joseph (born May 1988), Joseph Donald (born July 1989), Alexandra Claire (May 1992), Lia (born July 1995 in China) and Niki Lin (December 1996 in China). Chloe makes Dan's brood seven.

Marino released a statement to the NY Post ... saying,
I take full responsibility both personally and financially for my actions now as I did then. We mutually agreed to keep our arrangement private to protect all parties involved.

My wife and I have been married for almost 30 years and have six children together. And we continue to be a strong and loving family.
In terms of past CBS incidents, one only has to go back to 2009, when news emerged -- including from Letterman himself -- that he had been being blackmailed over an extramarital affair. Letterman and his wife, Regina Lasko, had been married just six months at the time and shared a young son.  The couple has stayed together.

49ers rebuke Chris Culliver for his anti-gay rant; listen to his statements

The San Francisco 49ers were quick to reject the anti-gay comments of cornerback Chris Culliver. Culliver made his statements on Tuesday (embedded), during the Super Bowl XLVII media day, and on Wednesday the team issued a statement in response.

Chris Culliver is currently a backup cornerback for the 49ers, although he started sixthis season. He made his homophobic comments to Artie Lange during a radio interview.

When asked if gay players would be welcome on the team, Culliver replied:
I don't do the gay guys man. I don't do that. No, we don't got no gay people on the team; they gotta get up out of here if they do. Can't be with that sweet stuff.
What's interesting is the background audio: "Stop the tape" and "Why is the tape still running?"Lang responded by asking Culliver if it all really mattered if the gay player could play well. Culliver responded by reaffirming his remarks:
Nah. Can't be ... in the locker room, man. Nah.
In addition, Culliver added that if a gay player were to ever reach the pro ranks, not only should he stay in the closet during his career, he should stay quiet for 10 years after retiring.

In response, the 49ers issued the following statement on Wednesday afternoon:
The San Francisco 49ers reject the comments that were made yesterday, and have addressed the matter with Chris. There is no place for discrimination within our organization at any level. We have and always will proudly support the LGBT community.
The 49ers also said they spoke to Culliver. As such, after the 49ers released their statement, Culliver did, as well:
The derogatory comments I made yesterday were a reflection of thoughts in my head, but they are not how I feel. It has taken me seeing them in print to realize that they are hurtful and ugly. Those discriminating feelings are truly not in my heart. Further, I apologize to those who I have hurt and offended, and I pledge to learn and grow from this experience.
The San Francisco 49ers face the Baltimore Ravens on Feb. 3 for Super Bowl XLVII. The two teams are coached by brothers, Jim Harbaugh (49ers) and John (Ravens); the game has been dubbed the "Harbowl."

Lindsay Lohan has a new half-brother, as father Michael and Kate Major welcome son

Lindsay Lohan has a new half-brother, as of Wednesday. It's unclear if she will treat him any better than her recently uncovered half-sister.

Her father, Michael Lohan, saw his fiancee Kate Major give birth to a baby boy in a Florida hospital. Kate Major gave birth to a son, Landon Major Lohan, at 11:39 a.m. PST. Landon weighed 7 pounds, 5 ounces at birth, and measured 19 3/4 inches.

Daddy was there with Kate Major the whole time. He even cut the umbilical cord. It was the 52-year-old's sixth child.

His ex-wife, Dina Lohan, even congratulated her former husband (video embedded). The reports of her congratulatory message noted, though, that her statement was made with the most begrudging tone of voice ever heard.

The video clip of Dina Lohan was caught after daughter Lindsay's court date today. Dina Lohan was out in Los Angeles, and was asked if she had anything to say to Michael Lohan after Landon's birth. It was a rather weak message, but it was still there.

Considering the late night flight she and Lindsay had to make to get to California in time for her court date, Dina Lohan was probably exhausted.

Emmylou Harris charged with misdemeanor hit-and-run

The lawyer for country legend Emmylou Harris entered a plea in her hit-and-run driving case on Wednesday, and it was "not guilty." As we reported in late December, Harrishit a car on a Los Angeles freeway on Oct. 1 and then left the scene.

Harris was, at the time, driving a rental car on the 405 Freeway when she allegedly struck a car. She reportedy left the scene without exchanging info and was said to not even stop.

At the time of the December report, authorities had just completed their investigation. They have since decided to charge Harris with misdemeanor hit-and-run, with the charges filed on Wednesday.

At the time of the report, Emmylou Harris' representative called the fender bender a "garden-variety accident that happens every day on the 405," claiming Harris only left the scene because she didn't realize she struck another car. The rep added that Harris had already turned the case over to her insurance company.

If convicted on the hit-and-run charge, Emmylou faces up to 6 months in jail.

According to California state law,
the driver of any motor vehicle that has been involved in an accident or collision, regardless of the level of seriousness or extent of injury, must stop, find the owner of the damaged property and produce his or her driver documentation.
The vehicle codes involved in California are:
Vehicle Code Section 20002 - When an accident results only in property damage (including motor vehicles), the driver must stop and locate owner or person in charge and exchange driver documentation. If owner of damaged property cannot be located, the driver is not permitted to leave the scene of the accident until the following actions have been completed:
  • Leave a note with facts surrounding the case and driver documentation information.
  • Report the accident to the California Highway Patrol (CHP) or local police.
Vehicle Code Sections 20001, 20003, and 20004 - Any accident that involves injury or death mandates the driver to perform all actions included in Section 20002 plus render reasonable assistance to the injured party or parties.
Harris was allegedly in violation of Vehicle Code Section 20002, in this case.

Lindsay Lohan's new lawyer rebuked by judge after he tries flattery

Lindsay Lohan and her new lawyer, Mark Heller, made it to their court hearing in front of Judge Stephanie Sautner on Wednesday, and although Lohan wasn't immediately thrown behind bars, Judge Sautner set up several future court dates to cover the troubled actress' legal issues.

Lohan has been charged with lying to the police, reckless driving and obstructing officers from performing their duties. The charges stem from her Pacific Coast Highway crash last June. She initially said she was not driving her Porsche, but in reality she was behind the wheel.

Sautner scheduled Lohan's case to be brought back into court on March 1, and again on March 18, assuming it goes to trial. While Lohan is not required to attend the pretrial hearing on March 1, Sautner said that the actress must be present on March 18.

Multiple reports said that Lohan had tried to get out of the hearing by saying she was sick, but Lohan, who was also reported as rushing to California after it became clear she could face a warrant for her arrest if she did not show up, said she changed her mind at the last moment to "show respect to the court."

Sautner, who has a lot of experience with Lohan, didn't appear to believe her. She also teased Lohan, somewhat, with comments about her health. Sautner first said, "I'm glad to see you're feeling better, then asked about Lohan's upper respiratory illness, She asked, "Is that like a cold?"

When Heller tried to liken Lohan's illness to the flu, Judge Sautner rebuked him with the comment, "No, it’s not. The flu is the flu."

In another part of the hearing Heller attempted to make small talk with Sautner, but she didn't take kindly to that, either. She said, "Flattery doesn't get you anywhere in this court." Ouch.

However, not only did Lohan get a lucky break with no jail time, she got more good news. Sautner said she will be retiring just before Lohan's next hearing.

There was also some bad news, though. Even if Lohan was found not guilty in the lying to the police case, her probation in the jewelry case could still be violated since the standard of proof is lower.

The secret to Disney snagging J.J. Abrams for 'Star Wars: Episode VII' was saying 'please'

How did Disney convince J.J. Abrams to helm "Star Wars: Episode VII" after he initially turned them down? They asked nicely, and said please, a report said Wednesday.

That's not a joke. It is, in fact, true that Abrams first turned the offer down. However, Kathleen Kennedy, who was named the co-chair of Lucasfilm when it was acquired by Disney last year, as well as the go-to producer of the company for at least the next five years, badly wanted Abrams for the job.

The fact that he brought "Star Trek" back to life didn't hurt matters. However, Abrams' agent said he was too deeply enmeshed in the "Star Trek" franchise and about humerous TV projects to even consider doing "Star Wars: Episode VII."

Still, Abrams agreed to meet with Kennedy at Bad Robot on Dec. 14. Kennedy said her pitch was very soft-pedaled, simply saying "Please do 'Star Wars." Despite hsi reservations, Abrams apparently "flipped out" when he learned that Michael Arndt ("Little Miss Sunshine") was scripting the film and that Lawrence Kasdan (who inked both "The Empire Strikes Back" and "Return of the Jedi") had signed on as a consultant.

On Dec. 19, Kennedy and Arndt met secretly with Abrams for a three-hour discussion about "Star Wars." What's interesting is that it was later in the month that Abrams denied any involvement with "Episode VII" and that he had turned it down.

Abrams spoke of Kennedy's persuasiveness. He said, "I learned firsthand how incredible and persuasive she is. The thing about any pre-existing franchise -- I'd sort of done that. But when I met with Kathy, it was suddenly very tantalizing."

It took more than a month for Abrams to officially commit to "Star Wars," and during that period, he continued to tell his associates that he was not signed to the project. Finally, he signed to the movie on Jan. 25, after a day of what was called "furious negotiation."

What about a timeline? It took Abrams four years to make a sequel to the rebooted 2009 "Star Trek" film. "Episode VII" has been scheduled -- loosely -- for 2015. Kennedy said, "Our goal is to move as quickly as we can, and we'll see what happens. The timetable we care about is getting the story."

If it sounds a lot like video game companies like Blizzard, who target a game release for when it is ready, it is. "Star Wars: Episode VII" is still slated for 2015. Abrams' latest film, "Star Trek Into Darkness" opens on May 17.

Rick Ross drive-by: Woman 911 caller hid as gunmen returned

On Wednesday, authorities released the 911 call made in the Rick Ross drive-by shooting case. The call, embedded below, was made early Monday morning from a restaurant in Ft. Lauderdale, Fla., as the rapper was trying to flee from the shooter in his Rolls-Royce.

As the gunshots echoed, the call was made by a woman inside of a nearby restaurant. She said, "I just heard a bunch of gunshots go off ... and a car sped by." As the caller spoke to the operator, though, things worsened quickly.

Still speaking to the 911 operator, the woman interrupted her and said, "Oh my god, they're turning around and coming back. I'm hanging up." The operator attempted to get more information about the situation, but the caller fired back (no pun intended), "They're coming back. I'm hiding."

The caller then hung up.

On Monday, Ross crashed his Rolls-Royce into an apartment building in Ft. Lauderdale as he was attempting to flee from a drive-by shooting, one in which he was the intended target. Ross was driving the car, and Shateria L. Moragne-el -- who is reportedly dating the rapper -- was riding in the passenger's seat.

According to reports, another vehicle pulled up next to Ross' car, and someone inside opened fire on the Rolls-Royce. Neither Ross nor Moragne-el was shot during the encounter, but local reports said that "dozens" of shots were fired at the vehicle during the 5 a.m. EST incident.

None hit the Rolls-Royce, but buildings in the area were struck by the gunfire. Ross' crashed into the apartment building while trying to flee from the gunfire. So far, the police have not made any arrests in the case.



Ronaiah Tuisosopo says he fell in love with Manti Te'o during 'Lennay Kekua dead girlfriend hoax'

Not that it should work to excuse him from the "dead girlfriend" scam that he worked on Notre Dame linebacker Monti Te'o, but Ronaiah Tuisosopo, in an excerpt of his two-part interview with Dr. Phil, said he thinks he's gay; he's not really sure. Portions of the interview were shown on "Today" on Wednesday (embedded).

Not only that, Tuisosopo said that over the time of the scam, not only did her perform the voice of Lennay Kekua, he fell in love with Te'o. Dr. Phil McGraw told NBC’s Mike Taibbi in the segment that aired:
Here we have a young man that fell deeply, romantically in love. I asked him straight up, "Was this a romantic relationship with you?" And he says yes. I said, "Are you then therefore gay?" And he said, "When you put it that way, yes." And then he caught himself and said, "I am confused."

The full two-part interview will air Thursday and Friday on the “Dr. Phil’’ show. In it, Tuiasosopo, 22, said that Te’o was an innocent victim in the hoax. Lennay Kekua was nothing except a fictitious person, but her supposed death from leukemia on Sept. 12 -- the same day Te'o's grandmother died -- made national headlines as Te'o played an incredible game against Michigan State just a few days later.

Her death and Te'o's performance were turned into a huge story around Te’o during Notre Dame’s undefeated regular season and his race to the finals of the Heisman Trophy.

Reportedly, Te'o learned of the hoax in early December, but did not reveal it to anyone but Notre Dame administrators, on Dec. 26. The hoax went national after being exposed by Deadspin.com on Jan. 16.

Tuiasosopo said he thought, many times, of ending it sooner than he did. Kekua and Te'o were together, off and on, for four years.
I wanted to end it because after everything I had gone through, I finally realized that I just had to move on with my life. I had to start just living and let this go. There were many times where Manti and Lennay had broken up, but something would bring them back together whether it was something going on in his life or in Lennay’s life, or in this case, my life.
Tuiasosopo created a fake social media profile using photos taken -- without her knowledge -- from the Facebook page of former high school classmate Diane O’Meara, 23, a marketing executive from Los Angeles. O'Meara said earlier that she although she went to high school in California with Tuiasosopo, they're not close.

He also insisted -- despite speculation otherwise -- that the telephone voice of Kekua in voicemails and conversations with Te’o was his own.

In conclusion, and perhaps putting to rest rumors that Te'o was involved in the hoax as a way to promote his Heisman Trophy candidacy, McGraw told Taibbi that, after speaking with Tuiasosopo, he believes that Te’o “absolutely, unequivocally’’ was not involved in the hoax in any way.

Jim Nabors marries partner of 38 years

Jim Nabors, 82, of "The Andy Griffith Show" and “Gomer Pyle, U.S.M.C.” fame announced his marriage on Tuesday. He and his longtime partner, Stan Cadwallader, 64, were wed earlier this month, but did not announce their marriage until Jan. 29.

In order to wed, the couple flew from their Honolulu, Hawaii home to Seattle, Wash. to be married on Jan. 15. Gay marriage became legal in Washington state in December, last month.

The couple first met in 1975 when Cadwallader was a Honolulu firefighter; they've been together for 38 years.

Nabors said that has been open with co-workers and friends about his sexuality, but this is the first time he has announced it to the media. It follows closely the coming out of actress Jodie Foster, who announced her homosexuality at the Golden Globe Awards earlier this month.

Nabors said:
I’m 82 and he’s in his 60s and so we’ve been together for 38 years and I’m not ashamed of people knowing, it’s just that it was such a personal thing, I didn’t tell anybody. I’m very happy that I’ve had a partner of 38 years and I feel very blessed. And, what can I tell you, I’m just very happy.
In terms of activism, Nabors said he would not become involved in LGBT issues.
I’m not a debater. And everybody has their own opinion about this and actually I’m not an activist, so I’ve never gotten involved in any of this.
Nabors became an a star when he joined “The Andy Griffith Show” in the spring of 1963. The character of Gomer Pyle (embedded video of him with one of his familiar quotes, “Surprise, surprise, surprise!”) became so popular that in 1964 CBS spun the character off in “Gomer Pyle, U.S.M.C.”

The new show lasted five seasons, and moved Gomer from his hometown of Mayberry -- where he pumped gas at a service station -- to become a Marine recruit. His innocent country attitude annoyed his sergeant, Sgt. Carter (Frank Sutton).

He also starred in the "Jim Nabors Hour," a variety TV series he hosted that aired on CBS from 1969 to 1971.



Panicked, Lindsay Lohan jets to California for her court date

After seeing news reports posted showing her seemingly healthy in New York City, ones that also said that if she didn't show, the judge might issue an arrest warrant for her, Lindsay Lohan panicked and quickly flew to California late Tuesday night.

The embedded video shows Lohan at JFK Airport last night.  She was accompanied by her mom, Dina Lohan.

It's unclear if the story -- reported in many media outlets -- showing Lohan hale and hearty last Saturday, when she had supposedly been examined by a doctor, who wrote a note saying that she couldn't fly because she had an upper respiratory infection.

Her new lawyer, Mark Heller, not only passed along the doctor's note, he included a New York Post article from earlier this month saying that a flu epidemic had hit New York City.

After the story hit the media, though, apparently Lohan panicked, feeling that a) the judge might see the story, and b) the judge might issue a bench warrant for her arrest, as we noted.

In addition, sources say that Lohan pleaded -- again -- with her former lawyer, Shawn Holley, to return to the case, but Holley made it clear a number of days ago that she was done with Lohan.

In addition, Heller -- and Lohan -- has another problem. The lawyer he asked to sponsor him, something he needs as he is not licensed to practice in California, has never met him. It's possible the judge will deny him the right to represent Lohan, which will make Lohan lawyerless.

Justin Bieber breast-cupping image just a trick of the camera angle

In the wackiest (recent) event in Justin Bieber's life, an image of him cupping a fan's breast was posted to his official fan web site, appearing Monday, for a time, before being taken down. The image shows Boober, er Bieber, appearing to touch Jocelyn, as she is identified on her Twitter account, inappropriately.

@JocelynBieber tweeted: "IM DYING HAHAHAHHAHA IT LOOKS LIKE JUSTIN'S TOUCHING MY BOOB IN THE PICTURE AHAHAHAHHA." Her Twitter feed was filled with tweets from others telling her how lucky she was; she has to repeatedly tweet a) she did not ask Bieber to touch her breast; b) he did not touch her breast.

Another tweet said: "people can think what they want but I know what really happened & Justin does too so everyone else's opinions don't matter to me."

A little interpretation from those tweets, and it seems as though Bieber didn't really touch or cup her breast at all. Instead, it appears the picture was just ill-timed, and his hand is in front of her breast in such a way that -- since the image is two-dimensional -- it looks like he is touching her breast.

Indeed, it seems it was a trick of the camera angle. No, fans, it's not that Bieber has so much testosterone running through his system after splitting from Selena Gomez that he went overboard. The encounter apparently took place during the pop star's Boyfriend tour.

Oh, for the future, and three-dimensional web pages, right?

Is Lindsay Lohan courting a bench warrant with claim of illness?

Lindsay Lohan is scheduled to be in court in Wednesday, but she's not going to be. TMZ learned on Tuesday that the troubled actress, who was ordered by a judge to appear on Jan. 30 for a hearing on her charges of lying to the police, claims she is sick, and thus can't attend the hearing.

Her new lawyer, Mark Heller, has submitted documents notifying the judge that Lohan will not be in attendance due to her illness. The note, from a Park Avenue physician, says that Lohan has an upper respiratory infection and can't fly, both for her own safety as well as the safety of the general public.

It is unclear if that excuse will fly (pun intended). However, in addition to the physician's note, Heller provided an article from the New York Post dated Jan. 11, reporting that a flu epidemic has hit New York City.

However, TMZ had a number of pictures showing Lohan partaking of an all-day shopping spree in SoHo in New York City on Saturday. While you might wonder why that is relevant, that's the same day the doctor allegedly examined her. Yet, not only was she shopping up a storm, she was also seen smoking, which would seem to be ill-advised if she has a respiratory infection.

Lindsay Lohan recently dumped her long-time lawyer, Shawn Holley. She hired Mark Heller, a New York lawyer not licensed to practice in California, instead. It's unclear why, but the question of money has been raised.

Lohan apparently owes Holley $300,000 and hasn't paid her in six months; Heller may even be taking her case gratis, for the publicity. Heller still needs to get approval to represent her.

On the other hand, it's unclear that Lohan is in trouble as TMZ posits. After all, unless the judge is reading this article, how would he know about her antics? It's unclear that the evidence is admissible (in court), either.

Chris Brown ready to talk to authorities about Frank Ocean brawl: Sources

Police say they want to talk to Chris Brown in the aftermath of his reported brawl with Frank Ocean, and on Tuesday, it was reported that the desire goes both ways. Chris Brown apparently wants to speak to the police, as well.

According to sources, Brown is adamant: He says he didn't start Sunday night's fight between himself and his entourage and Frank Ocean and his entourage. He is reported to be extremely interested in telling the police his side of the story.

In fact, according to law enforcement sources, Brown's lawyer, Mark Geragos, has already contacted investigators. He told them that Brown is ready to respond to questions regarding the Sunday night bruhaha that began in the parking lot of the Westlake Studio in the Los Angeles area.

In addition, Geragos says he has surveillance video of part of the fight -- but only the last part -- and Brown did not throw a punch. However, it looks like Frank Ocean is just as squeaky clean. The video clears Ocean and Brown, and shows that the two entourages were the ones swinging at each other.

To be perfectly clear, though, the video only shows the final part of the fight. It doesn't show who started the fight. As noted above, the dust-up began in the parking lot, but then moved into the lobby, where the security footage was captured.

That means there will be arguing over who started the fight. A witness has claimed that Chris Brown threw the first punch, but that's not what Brown says.

You may recall that when police arrived, Brown was gone, although Ocean was still there. The reason for that is that Geragos had told his client to leave immediately if he ever got in a situation where trouble was on the horizon.

Mark Geragos, for those unaware, is considered a "celebrity attorney." Clients that he represented in the past include Brown, Michael Jackson, Winona Ryder, politician Gary Condit, Susan McDougal, Scott Peterson, suspended NASCAR driver Jeremy Mayfield, Paul and Kulbir Dhaliwal (the two brothers injured after a tiger escaped from the San Francisco Zoo). He assisted David Carradine's family during the investigation into his accidental auto-erotica induced death.

They're only friends, but with benefits: Lindsay Lohan and Max George

Speculation over a possible relationship between "The Wanted" singer Max George and Lindsay Lohan was dispelled on Monday. Sources say that Max and Lindsay are just friends -- with benefits.

The information was dished by Lohan's own friends after somewhat of a dissing by George. Lohan posted the above image on Instagram a few days ago, showing her and Max apparently joking around on camera.

Once it was posted, George's erupted on Twitter, with tweets such as "If you date Lindsay, I will die!" There is some serious groupie angst in that sort of tweet.

In response to that sort of begging, George tweeted:
Rumours... That's all... Like I said... 1million % :) X
Ouch. However, Lohan isn't torn up about George denying that any sort of relationship exists. The reason is because it's true.

According to the report, Lohan has told friends that the couple isn't a couple That is to say that Lohan and George aren't boyfriend and girlfriend, but in stead just no-strings-attached non-exclusive hook-up buddies (translation: f*ck buddies).

To be clear, Lohan has not placed her heart on a string. She just likes hanging out with George and isn't taking the relationship seriously.

Whether or not they are a couple, LiLo and George have been seeing each other since last year. It's been said to be a groupie-type relationship, dating, or not dating. At this point, nobody knows except the couple, and they're talking in pretty vague terms.

Kris Jenner cuts deal; 'Momager' to get her own daytime talk show

Will there be a new "Keeping up with the Jenners" show? Perhaps not, but no matter what, on Monday it was announced that Kris Jenner has signed a deal for her daytime talk show, which will be called "Kris."

Coming from Twentieth TV, "Kris" will be a daily one-hour talk show. Along with the de rigueur celebrity guests there will be discussions about fashion, beauty tips, and general lifestyle coverage. The show will be filmed in Los Angeles, Calif.

Stephen Brown, Twentieth’s EVP of Development and Programming, said, in a statement:
The latest adventures, successes and disappointments surrounding the extensive Kardashian and Jenner family fill entertainment magazines and create daily online headlines.

At the center of this fascinating empire is Kris Jenner –- a dedicated mom and a successful business woman. Whether offering real advice to her family or sharing personal moments with viewers, Kris is honest, compelling, entertaining, and unscripted –- all excellent qualities for a daytime talk show host.
In her own statement, Kris Jenner said,
This is something I have wanted to do all my life so it’s definitely a dream come true! I can’t wait for this new adventure to begin.
There has been a lot of drama in the Jenner household of late. Numerous rumors that she and husband and former Olympic gold medalist Bruce Jenner were going to split have been shot down. This new show could prove to be dramatic as well: The program's summer run is considered a test.

It will slot in alongside talk shows hosted by Wendy Williams and Bethenny Frankel, both of which are nationally syndicated. Frank Cicha, SVP of programming, Fox Television Stations, said,
Wouldn’t be summer without at least one test, would it? In all seriousness, we go into this believing that if it works, the Kris Jenner program could really complement what we’ve got going with Wendy, Bethenny, etc.
Jenner is considered the matriarch of the combined Jenner - Kardashian clan. She is reportedly the manager overseeing the empire, and has earned the name "Momager" as a result.

Given that, one would assume the odds of success are good.

DJs involved in 'Kate Middleton hospital call prank' to return to the airwaves

The DJs involved in the "Kate Middleton prank call scandal" will eventually return to the airwaves of the same station that they were working on when they pranked King Edward VII Hospital nurse Jacintha Saldahna, it was announced on Monday. Saldahna killed herself a few days later.

Southern Cross Austereo is the parent company of radio station 2DayFM, which carried the two DJs and their show "Hot 30." Chief Executive Rhys Holleran was quoted as saying DJs Michael Christian and Mel Greig will go back on the air.

"We look forward to Mel and MC returning to work when the time is right, in roles that make full use of their talents," Holleran said in a statement Monday.

SCA announced that the show itself, "Hot 30," was formally canceled. Based on that statement, it appears that earlier reports that indicated "Hot 30" was cancelled were incorrect; the show had instead been suspended, as were the DJs.

On Dec. 4, Greig and Christian impersonated Queen Elizabeth II and her son, Prince Charles, when they phoned London's King Edward VII hospital in the early hours of the morning to ask about the condition of Kate Middleton, the Duchess of Cambridge. Middleton had been hospitalized for severe morning sickness.

Saldanha was fooled, and who put them through to a colleague who -- in turn -- answered questions about Middleton's condition. Saldanha's body was found hanging in her room three days after the prank in an apparent suicide.

Both the show and the DJs were heavily criticized after the incident.

Rick Ross drive-by shooting: Authorities look to security cameras

Rapper Rick Ross had a narrow escape on Monday morning, and police are examining surveillance footage from businesses near the incident in an attempt to gather evidence.

On Monday morning, Ross crashed his Rolls-Royce into an apartment building in Ft. Lauderdale, Fla. as he was attempting to flee from a drive-by shooting, one in which he was the intended target. Details are slowly unfolding, but it's been confirmed that Ross was driving the car, and Shateria L. Moragne-el -- who is reportedly dating the rapper -- was riding shotgun (no pun intended)

Police say another vehicle pulled up next to the Ross' car, when someone inside opened fire on the Rolls-Royce. Ross was not shot during the incident, nor was Moragne-el. Local reports say that "dozens" of shots were fired at the vehicle during the 5 a.m. EST incident. None hit the Rolls-Royce, but buildings in the area were struck by gunfire.

Ross' crashed into the apartment building while trying to flee from the gunfire.

Meanwhile, the police are looking toward security cameras at a building across the street from the crash. They were reportedly rolling during the incident, and authorities hope the video will either reveal the car, its license plate, or even the identity of the shooter.

So far, no suspects have been identified and no arrests have been made. The suspects fled from the scene before police arrived.

Test results don't lie: Kris Humphries claims there's no way he gave Kayla Goldberg herpes

A woman named Kayla Goldberg earlier filed a lawsuit against NBA player Kris Humphries, claiming that he gave her herpes after a raincoat-less sexual encounter in Hollywood back in 2010. On Monday, TMZ reported that Humphries fired back at Goldberg's lawsuit, which she filed way back in August.

In his filing, he said that not only is he 100 percent herpes free, he has the verified test results to prove it. Humphries filed his paperwork in Los Angeles County Superior Court. He does not deny sleeping with Goldberg -- that doesn't seem to be in question -- but insists he could not have given her herpes, as -he was tested for the disease after their encounter, and the test was negative.

Humphries included the test results in his filing, but they are under seal. He has requested that Goldberg's lawsuit be dismissed, but a judge has yet to rule.

It appears that Kris Humphries' love life hasn't improved now that he and Kim Kardashian have split. He wants an annulment, and reports are that Kardashian is willing, wanting him out of her life ASAP, but that Mama Jenner has said no.

At this point, if Kardashian doesn't give him an annulment, then she will still be married to Humphries when the baby she is carrying -- Kanye West is the father -- is born.

Kardashian is about three months pregnant. Given that, she will probably give birth in late June.

The next court appearance for the Kardashian / Humphries lawyers to meet is -- ironically -- Friday, February 15, the day after Valentine’s Day. That appearance will only be used to set a date for the actual trial. Problematically for Kardashian, the earliest the trial can be scheduled would be the middle of June because of Humphries' NBA schedule.

Barbara Walters faces the specter of a childhood disease: Chicken pox

Barbara Walters was absent from "The View" on Monday morning. Co-host Whoopi Goldberg announced (embedded) why: Walters is suffering from chicken pox.

In addition, Walters was known to already be recovering from a head injury she suffered during the recent Inauguration weekend.

Goldberg said:
We want to give you an update on Barbara. You all know that she fell and cut her head 10 days ago, and then was running a temperature, but it turns out it is all the result of a delayed childhood.

Barbara has the chicken pox. She'd never had it as a child. So now she's been told to rest, she's not allowed any visitors. and we're telling you, Barbara, no scratching.

We love you. We miss you. We just don't want to hug you.
Normally thought of as a childhood disease, the effects of chicken pox are more severe in adults.

Walters could have avoided chicken pox by being vaccinated. A vaccine has been available since 1995. WebMD says that "All adults who have never had chickenpox or received the vaccination should be vaccinated against it. Two doses of the vaccine should be given at least four weeks apart."

Barbara Walters appears to have been a risk-taker when it comes to childhood diseases she never had. Her reps have not replied to questions about whether or not Walters has had mumps, measles, and the like.



Super Bowl ad for 'Oz the Great and Powerful' teased by Disney

On Monday, Walt Disney Pictures unveiled a teaser video for their Super Bowl ad for the upcoming movie, "Oz the Great and Powerful." The film is being directed by Sam Raimi; the first publicly seen footage for the film was unveiled at the San Diego Comic-Con last year.

The film is adapted from L. Frank Baum's 1900 novel "The Wonderful Wizard of Oz," but is set prior to that novel, and serves as a prequel to the familiar 1939 movie, "The Wizard of Oz."

The film stars James Franco as Oscar Diggs, a small-time circus magician who is sucked from (where else?) Kansas and into (also, where else?) Oz. There, he meets three witches, Theodora (The Wicked Witch of the West, Mila Kunis), Evanora (the Wicket Witch of the West, Rachel Weisz), and Glinda (The Good Witch, Michelle Williams).

The Wikipedia summary for the film is as follows:
Raimi's film is set before the events of the 1900 book and 1939 film. Oscar Diggs (James Franco), a small-time circus magician with dubious ethics, is hurled away from dusty Kansas to the vibrant Land of Oz. He thinks he’s hit the jackpot, with fame and fortune his for the taking ... that is, until he meets the witches Theodora (Mila Kunis), Evanora (Rachel Weisz), and Glinda (Michelle Williams), who are not convinced he is the great wizard everyone’s been expecting.

Reluctantly drawn into the epic problems facing the Land of Oz and its inhabitants, Oscar must find out who is good and who is really evil before it is too late. Putting his "magical" arts to use through illusion, ingenuity, and even a bit of wizardry, Oscar transforms himself not only into the great and powerful Wizard of Oz but into a better man as well.
Super Bowl XLVII will be played next Sunday, Feb. 3, broadcast on CBS with an estimated start time of 6:30 p.m. EST. The game pits Jim Harbaugh's San Francisco 49ers against brother John Harbaugh's Baltimore Ravens (Jim is the younger of the two) in the "HarBowl."

The film, meanwhile, opens in 3D, 2D and IMAX 3D theaters on March 8.


Chris Brown involved in all-out brawl with Frank Ocean

Chris Brown is in hot water for what is allegedly another explosion of anger. It took place on Sunday night, when Brown and Frank Ocean had a fight, allegedly over a parking spot.

The information about the altercation being a parking spot bruhaha came from both the initial report, as well as a follow-up report from the Los Angeles County Sheriff's Department, which stated that witnesses said there had been a brief fight over a parking space.

The Sheriff's Department said,
The altercation allegedly led to Chris Brown punching the victim.
The majority of details come from TMZ. Sources said that Brown was at the Westlake Studio in the Los Angeles area listening to one of the artists he represents. However, according to the report, as Brown as about to leave, Frank Ocean and his team blocked his car, preventing him from leaving. The sources say Frank said,
This is my studio; this is my parking spot.
Then things get very confusing. Allegedly, when Brown went to shake Ocean's hand, one of Ocean's group attacked him.

At that point, according to sources connected with Brown, one of Brown's friends jumped in front and hit Ocean's friend. A bruhaha then ensued, with a full-on brawl starting. The Sheriff's Department report said deputies had responded to a call saying six people were involved.

When authorities arrived, Brown was nowhere to be seen, but Ocean was. Since Ocean remained, in the law enforcement reports he is being referred to as "the victim."

Ocean posted the following two messages on Twitter. He said:
got jumped by chris and a couple guys. lol. i only wish everest was there.

cut my finger now I can't play w two hands at the grammys.
Ocean has six Grammy nominations this year; the ceremony is next month.

Strangely, above is a photo of Chris Brown in the studio on Sunday night. While it appears the photo was taken before the fight, it was uploaded to his Instagram account after the brawl, implying Brown didn't think too much about it.

Police say they want to speak to Brown.

The events are strangely reminiscent of 2009's incident in the run-up to the Grammy's. His attack on his then-girlfriend Rihanna on the eve of the 2009 show overshadowed the ceremony.

In June of 2012, he was injured in a another brawl, that time with members of hip-hop star Drake's team at a New York City nightclub.

Jeremy Shockey's estranged wife up in arms about him posting naked pics of her 'tight end'

Daniela Cortazar-Shockey, the estranged wife of former NFL football star Jeremy Shockey, is hot. We don't mean hot in terms of sexy -- which she is -- but rather, hot under the collar after Shockey recently Instagrammed her bare butt, as TMZ reported on Sunday.

Cortazar-Shockey married Jeremy last May, only to separate from Shockey in October, just filed legal documents contesting their prenuptial agreement. The prenup essentially leaves Cortazar-Shockey with nothing in the event of a divorce -- which may or may not be all that bad considering that Shockey didn't play in 2012 -- but Cortazar-Shockey claims that under Florida law she is still entitled to temporary alimony and lawyers' fees.

The naked butt photo, though, has added fuel to the proverbial fire, and made Shockey's soon to be hot ex-wife hot under the collar. Cortazar-Shockey is also demanding at least $15,000 from the footballer, claiming he violated a privacy provision in the prenuptial agreement by posting a picture of Daniela's butt on Instagram recently. That posting was long after the pair had split up.

The picture has since been removed from Jeremy's social networking accounts, but as they always say, "what gets posted to the Internet, stays on the Internet."

Cortazar-Shockey is also asking the court to compel Shockey to stop posting about her on the Internet.

There has, as yet, been no ruling on her motion. As you might recall, Shockey filed for divorce earlier this month, claiming their marriage was "irretrievably broken" after just eight months.

Miley graces the cover of Cosmo; calls Hemsworth 'my hubby'

Miley Cyrus graces the cover of the March issue of Cosmopolitan, but the sexy image has already been revealed and so has some very interesting information: Cosmopolitan tweeted the cover picture and a teaser interview on Saturday, and in it, Miley dropped a bombshell, referring to Liam Hemsworth, thought to be her fiance, as "her hubby."

While Miley herself also added a few other sexy images via her own Twitter account, all the noise around her sexy cover and photo shoot seems drowned out by the "hubby slip of the lip."

In the f-bomb filled teaser interview (the full interview, naturally, can only be found in the March edition of Cosmopolitan), when asked about Hemsworth's hotness, Miley said:
I'll literally look at him and be like "You are hot, dear god!" The other day, I turned on the pool heater and it was steaming, and he walked outside and took off his clothes and jumped in the pool.

I was like, "I'm gonna faint--the hottest guy of my life is in a steaming pool. This looks like a Playgirl shoot." So I took a photo and made it the background on my phone. My best friend grabbed my phone and was like, "Who's that? He is so hot!" That's my hubby!
"That's my hubby!" The interview ends right there, which could be a non-coincidental decision by Cosmopolitan, which might see a number of extra copies sold as people try to see what the next sentence out of Cyrus' mouth is, as one would expect the interviewer to follow up with a question regarding the "hubby" comment.

That's the big news out of the Cosmopolitan interview, thus far, but the cover image and leaked photos are both classy and sexy. The cover shot, for one, shows off some nice cleavage and a taut set of abs, but does not cross any lines.

The blurb next to the images shows that readers can expect Miley to open up in the interview: "It's Miley, b*tches; I've never faked anything."

Along with the teaser interview, Cosmo added a behind-the-scenes video of Miley Cyrus' photo shoot, which has been embedded.

Voting closes on Audi Super Bowl XLVII ad: 'Worth it'

Super Bowl commercials are so important to companies that companies don't wait until the game to pimp their wares. On Sunday, Audi announced the winner of its “Choose Your Own” commercial promotion, which ran from Thursday until Sunday.

The nominees for Audi's Super Bowl ad all had a prom theme. The losers were titled "Tradition" and "Buddies." The winner is named "Worth It."

The premise of all the ads is simple: An unpopular student has no date to the prom. Still, he's going to go. While his mom tries to pump him up, saying "Nowadays a lot of people go by themselves," his very young sister says, "No, they don't."

However, Dad throws him a bone, and the keys to his Audi S6, as well. Once Dad does, everything changes.

All three ads start is the same, but each features a different ending. They all have the same general message, though: The S6 is a game-changer.

We won't give away the endings to the "losers," but in the winner, once the student gets into the S6, he drives up beside a limo, only to see an obviously prom-bound girl yell "Prom!" at him. He then parks in the principal's reserved spot, heads into the prom and promptly kisses the prom queen.

We then get to see the prom king, who isn't very happy. We also get to see if things were "worth it," as the ad asks.

Our hero ends up with the girl and a black eye.

Good and bad news for Casey Anthony: bankruptcy filing done on same day two convictions thrown out

Casey Anthony has filed for bankruptcy protection, it was reported on Sunday. The filing, done Friday, came on the same day that a Florida appellate court set aside two of the four convictions she faced for lying to detectives during the investigation into her missing daughter, Caylee Anthony.

In 2011, Anthony was acquitted in the 2008 death of her two-year-old daughter Caylee. in 2011, sought Chapter 7 bankruptcy protection in federal court in Tampa. The detectives were investigating the disappearance of the girl, who later was found dead.

According to the Chapter 7 filing, Anthony listed debts of $500,000 for attorney fees and costs for Jose Baez, her criminal defense lawyer during the trial; $145,660 for the Orange County Sheriff's office for a judgment covering investigative fees and costs related to the case; $68,540 for the Internal Revenue Service for taxes, interest and penalties; and $61,505 for the Florida Department of Law Enforcement for court costs.

In addition, the filing notes the civil suits she is a defendant in. In particular, one has been brought by Zenaida Fernandez-Gonzalez for defamation in Orange County Circuit Court. While detectives were investigating Caylee's disappearance, Anthony told them that a baby sitter by the same name kidnapped the two-year old.

Fernandez-Gonzalez claims her reputation was damaged by Anthony's statements. However, Anthony's attorney said Anthony clearly wasn't talking about Fernandez-Gonzalez, as details offered by Anthony to authorities did not match the plaintiff.

Chapter 7 bankruptcy protection differs from Chapter 13 bankruptcy protection in that the creditors can liquidate the majority of a debtor's assets, except for those deemed "exempt" by state law. The two types are described as follows:
Chapter 7 bankruptcy comes under the liquidation category. It's called liquidation because the bankruptcy trustee may take and sell ("liquidate") some of your property to pay back some of your debt. However, you may keep property that is protected (also called "exempt") under state law.

There are several types of reorganization bankruptcies, but Chapter 13 is the most common type for consumers. In Chapter 13 bankruptcy, you keep all of your property, but must make monthly payments over three to five years to repay all or some of your debt.
Court papers list Anthony as unemployed, with no recent income.

Although Anthony was acquitted of killing Caylee, jurors convicted her of four counts of lying to detectives; Her attorneys appealed those convictions. Anthony was sentenced to time served for those charges, which were misdemeanors.

Anthony was also sentenced to a year of probation after her release from jail for an unrelated case involving check fraud. Her whereabouts have been kept secret since she was released from state supervision in 2012, for her own protection.

Former 'Idol' contestants defend the show against claimed racism

Following on the heels of news that said that a New York attorney has made moves to bring a lawsuit against Fox, citing that racism was involved in the public ouster of nine former "American Idol" contestants comes a brand-new report on Sunday quoting four former "Idol" finalists, two of them who are African-American, rebutting the charges.

If New York attorney James H. Freeman is given the go-ahead by the U.S. Equal Employment Opportunity Commission (EEOC), a lawsuit may be forthcoming. Freeman has asked the EEOC for permission to sue "American Idol" and FOX on behalf of his clients, claiming their dismissals from "Idol" was part of a racist plot to boost the show's ratings.

Because of the nature of the suit -- elaborated on below -- Freeman is required to ask the EEOC. The list of nine is as follows:

  • Donnie Williams (season 3)
  • Terrell Brittenum (season 5)
  • Derrell Brittenum (season 5)
  • Thomas Daniels (season 6)
  • Akron Watson (season 6)

  • Chris Golightly (season 9)
Freeman claims he became suspicious of "Idol" when Jermaine Jones, not a client, was booted from the show in 2012's season 11. Producers claimed it was because Jones failed to inform them about outstanding warrants for his arrest.

At that point, Freeman said, he took a closer look. He conducted an investigation into the show, and according to the letter to the EEOC, he discovered that producers had only publicly disqualified nine other people from the show since its inception, and that all were African American.

As Freeman noted, though, the show's background check includes the question "Have you ever been arrested," which he claims violates California employment law. Freeman asserted that the contestants are essentially applying for "employment" with "American Idol." He alleged that "Idol" has been conducting a "cruel and inhumane" scheme, exploiting African American contestants for the purpose of ratings.

However, the four former contestants who spoke out on Sunday strongly disagreed. Season six finalist Melinda Doolittle adamantly said,
It is shocking to see such allegations. In my experience on the show, the "Idol" team strives to champion everyone, regardless of race. However, each contestant is explicitly told that the withholding of information that may compromise the show or artist, can and will result in immediate disqualification.
She is, of course, speaking regarding the Jones issue brought forth by Freeman.

Season four finalist Vonzell Solomon added,
I didn’t experience any of that [racial discrimination] ... all of our contracts were clear about how the background checks worked and that we could be disqualified if we lied about our past.
Season five winner Taylor Hicks said:
"American Idol" is for everyone. All walks of life go through the show. Not once did I see the show discriminate towards anyone. It’s all about the votes.
Finally, season 10 finalist Casey Abrams also agreed, saying,
I don't know why they are biting the hand that fed them. Those guys beat thousands of people who wanted to be on TV. "Idol" is picky, but I'm not sure about racist.
The only statement thus far has come from "Idol" executive producer Nigel Lythgoe, who said after being informed of the letter:
We treat everybody the same -- no matter the race, religion or sex. I think we've always had a fantastic share of talent from contestants both black and white -- I don't think I've ever seen racism at the show.
"Idol" has had three African-American winners in its history: Ruben Studdard, Fantasia Barrino and Jordin Sparks.

No felony child endangerment charges for Katt Williams

Katt Williams won't face any felony child endangerment charges stemming from his arrest in late December. Sources said on Sunday that Williams, who has been in and out of legal trouble a lot of late, has caught a break.

Originally, Williams was arrested for felony child endangerment at his Woodland Hills home after police discovered numerous guns -- and marijuana. Williams didn't agree with the endangerment portion, as he asked immediately after his release that same Friday night (video embedded here), "How do you protect your kids without guns?"

The case is being moved to the Los Angeles City Attorney's office (which handles misdemeanors) from the District Attorney for a couple of reasons. For one, Williams insisted that his children couldn't gain access to the guns as they were locked up.

Secondly, there were so many people living in the house at the time of his arrest that there was no way to directly tie Williams. It is called "beyond a reasonable doubt."

With that, the D.A. decided not to file felony charges. According to the sources, although the L.A. City Attorney could prosecute, it's unlikely. The report said that instead Williams will be made to appear at an informal hearing at the City Attorney's office, where he'll be warned.

'Big Rich Atlanta's' Ashlee Wilson-Hawn threatens lawsuit over nude images

The Style Network's new reality television series, "Big Rich Atlanta" premiered on Jan. 23, but already one of the stars has naked photos being shopped around. The news hit Sunday, and Wilson-Hawn is not just upset, she's threatening a lawsuit, a report said on Sunday.

Wilson-Hawn is a former Miss Georgia Teen and is reportedly one of Atlanta most sought-after pageant coaches. She has warned warning media outlets that topless photos of her that are being shopped around were released sans her permission. Anyone who publishes them will see a lawsuit, she added.

Sources say that the images were taken during a recent modeling shoot, but that they weren't meant to really be topless. Wilson-Hawn is topless, but shown only in the familiar "covering her breasts with her hands so you can't see her nipples," which has been done by many, and is hardly titillating (pun intended).

However, there are truly topless photos being shopped. As a rep for Wilson-Hawn said:
In the process of photo shoots, there is always the possibility of someone capturing photos that they shouldn't be taking as all models are seen in various states of dress during such events.

Ashlee has never posed nude for a photo shoot and anyone that releases unlicensed and uncensored photos will definitely be sued.
In other words, as models walk around topless, photos that aren't supposed to be released may be taken. These ill-gotten images will earn legal action, though, if posted anywhere.

Whoever it is trying to sell them apparently didn't even wait to see if the show became a hit. Notably, although the show premiered on Jan. 23, the Style Network featured a special the week prior to introduce the cast.

The show stars 13 women, of whom Ashlee is just one -- but she's apparently already drawing a lot of attention. It follows in the footsteps of "Big Rich Texas," currently in its third season.

According to Style's website: Ashlee is "a former Miss Georgia Teen, Ashlee is one of Atlanta's most sought-after pageant coaches. A fixture on the Atlanta social scene, Ashlee is a highly-opinionated, old-money heiress who fancies herself a Boss B*tch."

Jenelle Evans bans husband Courtland Rogers from hospital room

Reality TV star Jenelle Evans tragically miscarried and lost her baby on Friday morning, but that's just the start of the drama. Reportedly, she has now banned Courtland Rogers, her husband and the baby's father, from her hospital room.

Evans and Rogers have been separated since earlier in the week: Rogers left his wife home alone on Sunday night and got drunk with some of his friends, and she has been furious at her husband since then. The couple has only been married for six weeks, and this isn't the first time they have split.

However, now Rogers wants to see her to comfort her after her miscarriage. He isn't able to. He said:
They won’t let me in! Gary answers every phone Jenelle has! They won’t let me in and her mom called the hospital and there are cops there!
Gary, for those unaware, is Evans' ex-fiance Gary Head, who is reported to be comforting Evans in her moment of need, standing at her bedside at the hospital.

Rogers added:
I’m so freaking upset! This is so f**ked up! That’s my kid!
Despite the loss of their baby -- and what could be called numerous fight -- Rogers says that he still loves Jenelle.
I am not leaving until I see my wife and kiss her! I don’t even care if the cops take me. I f**king love Jenelle so much no matter what she has done or lied about. I just can’t stop loving someone that easy, especially when she’s my wife.
It's unclear what will happen next. Earlier this week, the former "Teen Mom" star went to the magistrate in North Carolina and filed four charges of assault on a female and one charge of battery of an unborn child, against Rogers.
