It all stems from Maher's appearance on "The Tonight Show" with Jay Leno in early January (embedded). Then, he elaborated on his recent feud with Trump. He said that “what got [Trump] so mad was, we did a new rule one week that, supposed that perhaps Donald Trump had been the spawn of his mother having sex with orangutan," [because] “the color of his hair and the color of an orange orangutan is only two things in nature of the same color.”
As part of the joking around, Maher made an offer: $5 million to the charity of Trump’s choice (Maher suggested the “Hair Club for Men” or the “Institute for Incorrigible Douchebaggery”) if Trump were to prove Maher’s hypothesis to be wrong.
Never the one to take a joke, Trump released his birth certificate (literally noting he is not the son of an orangutan, but instead of Fred Trump), and demanded Maher pay up. He later threatened to sue. On Monday morning, he told "Fox & Friends" that he did plan to sue Maher, around noon on Monday.
Trump said, “He promised me $5 million for charity if I provided certain information. Well I provided the information. He didn’t pay. So today I sue Bill Maher for $5 million for charity.
“I accepted the offer immediately, and he didn’t come through with the $5 million,” he added.
When he was told that perhaps Maher was joking, Trump had a differing opinion. He said, “I don’t think he was joking. He said it with venom. That was venom. That wasn’t a joke. In fact he was nervous when he said it. It was a pathetic delivery.”
Did Maher say it with venom? The "offer" he made when he was visiting Jay Leno is embedded below; decide for youself.
